3.36.300 Commissioner--Appointment and duties.

The director of welfare shall appoint the commissioner of adult services, whose duties shall be those prescribed by Article XIII, Section 14A(c) of the Charter and additional duties as prescribed by ordinance. (Ord. 49458 § 1, 1959: 1948 C. Ch. 2 § 80(a) 1960 C. § 185.030.)

3.36.310 Presentence investigation defined.

Each presentence investigation shall consist of at least the following:

A. Description of offense and background circumstances based on police reports and any other objective information concerning the offense;

B. Defendant’s explanation of his/her involvement in offense;

C. List of all prior convictions of all state, federal, and municipal violations;

D. Social history of defendant including at least age, marital status and history, employment status and history, and defendant’s education/training;

E. Probation officer’s evaluation of defendant’s attitude toward rehabilitation and need for such;

F. Probation officer’s recommendation to the court for sentencing and/or rehabilitation. (Ord. 58037 § 2, 1980.)

3.36.311 Presentence investigation fee.

There is hereby established a fee of twenty-five dollars ($25.00) for each presentence investigation conducted by the probation staff of the department of welfare, division of adult services, at the request of the municipal division of the circuit court of the City only for those defendants who plead guilty to or are found guilty of driving while under the influence of alcohol/drugs or any violation where alcohol is involved. The fee shall be paid to the City by the person undergoing the presentence investigation at the request of the municipal division of the circuit court of the City; provided, however, no fee shall be required to be paid by any person who is determined to be indigent under criteria established by the department of welfare, division of adult services.
