24.410 Generally, pure food and drugs
11.60.200 Prohibited possession.
Possession of controlled substances under circumstances which are unlawful under federal or state of Missouri laws is hereby prohibited. (Ord. 66417 § 2, 2004: prior: Ord. 62173 § 1, 1990.)
11.60.220 Penalty for violation.
Any person convicted of violating Section 11.60.200 shall be fined no less than one hundred dollars ($100.00) or more than five hundred dollars ($500.00) or by imprisonment up to ninety (90) days or by both fine and imprisonment. (Ord. 66417 § 3, 2004: prior: Ord. 62173 § 3, 1990.)
11.60.230 Prohibited premises for manufacturing, storing or distributing controlled substances.
It shall be unlawful for any person to knowingly open or maintain any premises for the purpose of unlawfully manufac-turing, storing, distributing or using any controlled substance. (Ord. 65482 § 1, 2001.)
11.60.240 Prohibited management or control of premises.
It shall be unlawful for any person to manage or control any building, room or enclosure as an owner, lessee, manager, agent, employee or mortgagee and intentionally rent, lease or make available for use, with or without compensation, the building, room or enclosure for the purpose of unlawfully manufacturing, storing, distributing or using a controlled sub-stance. 11.60.250 Definitions.
For purposes of this ordinance the term "controlled substances" shall be as defined in Chapter 195.010 et seq., as amended of the Revised Statutes of Missouri. (Ord. 65482 § 3, 2001.)
11.60.260 Penalty for violation of Section 11.60.230.
Any person found guilty or entering a plea of guilty to a violation of any provision of this ordinance shall be subject to a fine of not less than five hundred dollars ($500.00) or a term of imprisonment of not more than ninety (90) days or both a fine and imprisonment. (Ord. 65482 § 4, 2001.)
11.60.270 Enhanced penalty for violation.
A person found guilty of the offense of unlawfully possessing or using any controlled substance or distributing or deliv-ering any controlled substance to another person in or within one thousand feet of the real property comprising a public park or in or within one thousand feet of a church, school or daycare center shall be subject to a fine of not less than five hundred dollars ($500) or a term of imprisonment of not less than ninety (90) days or both a fine and term of imprisonment.
