17.40.010 Class I general offense.

It shall be a Class I general offense for any person to do any act forbidden by this division, or fail to perform any act required by this division. (Ord. 57831 § 1 (part), 1979: 1960 C. § 839.010.)

17.40.020 Penalties designated.

Any person convicted of a violation of this division shall be punished by a fine of not more than five hundred dollars ($500.00) or imprisonment for not more than 90 days in jail or both such fine and imprisonment. (Ord. 57831 § 1 (part), 1979: 1960 C. § 839.020.)

17.40.030 Conviction on alcohol or drug related traffic offense--Costs.

Pursuant to Section 577.048 of the Revised Statutes of Missouri, city court judges may order any person upon a plea of guilty or a finding of guilty for the offense of driving under the influence of alcohol or a controlled substance in violation of Section 17.16.290 of the Revised Code of the City of St. Louis to reimburse the St. Louis Metropolitan Police Department the costs associated with the arrest of said person. Such costs shall include the reasonable cost of making the arrest, including the cost of any chemical test made pursuant to Chapter 577 of the Revised Statutes of Missouri, to determine the alcohol or drug content of the person’s blood, and the costs of processing, charging, booking and holding such person in custody. A record of all such assessments and resulting collections shall be maintained by the Clerk of the City Courts and transmitted monthly to the Budget Division of the City of St. Louis. All monies collected pursuant to this legislation shall be maintained on the books of the City in a separate account established by the Comptroller. The St. Louis Metropolitan Police Department may establish a schedule of such costs; however, the court may order the costs reduced if it determines that the costs are excessive. 17.40.040 Moving violations in construction or work zones.

A. As used in this section, the term "construction zone" or "work zone" means any area upon or around any highway as defined in Section 302.010, RSMo, which is visibly marked by the department of transportation as an area where construction, maintenance, or other work is temporarily occurring.

B. Upon a conviction or a plea of guilty by any person for a moving violation as defined in Section 302.010, RSMo, or any offense listed in Section 302.302, RSMo, the court shall assess a fine of not less than fifty dollars ($50) nor more than two hundred and fifty dollars ($250) in addition to any other fine authorized to be imposed by law, if the offense occurred within a construction zone or a work zone.

C. This section shall not be construed to enhance the assessment of court costs or the assessment of points pursuant to Section 302.302, RSMo. (Ord. 65351 §§ 1--3, 2001.)
