IN GENERAL

20.02.010 Definitions.

The following words whenever used in this division shall have the following meanings unless the context otherwise provides:

A. "Commission" means the "municipal bridge commission" created by Chapter 3.70;

B. "Douglas MacArthur Bridge" or "the bridge" means and includes the bridge owned by the City, that crosses the Mississippi River between and connecting St. Louis, Missouri, and East St. Louis, Illinois, the approaches thereto, both vehicle and railroad, the equipment thereof and appurtenances thereto;

C. "Railroad" means and includes any common carrier, railroad corporation owning and operating any railroad transporting passengers and freight, by steam, electricity or any other kind of motive power;

D. "Railroad deck" means and includes the railroad deck and railroad approaches and all of the substructure under such vehicle and railroad decks;

E. "Vehicle deck" means and includes the vehicle roadway and sidewalk deck of the bridge, and the vehicle and sidewalk approaches thereto. (1948 C. Ch. 19 § 1: 1960 C. § 590.010.)

20.02.020 Construction and interpretation of division.

Nothing in this division, or in any permit, contract or agreement between the City and any railroad or railroads, which may be made pursuant to the provisions of this division, shall be understood or construed:

A. As constituting a waiver of or bar to the right of any railroad to obtain by any other lawful means, direct connections between the tracks of the railroad and the City’s present or future railroad approaches to the bridge, or any extensions thereof; or

B. As intended to interfere with the full exercise of lawful jurisdiction of the Secretary of War of the United States, or the Interstate Commerce Commission, or the Public Service Commission of Missouri, or any other lawfully constituted governmental authority, may at any time have over the Douglas MacArthur Bridge as an instrumentality of commerce, or the charges made by the City for the use thereof by common carriers or the rules, regulations or practices at any time enforced or sought to be enforced by the City governing the use of the railroad deck or its approaches by common carrier railroads using or seeking to use the same; or

C. As waiving rights the City may at any time have, to construct, extend, maintain and operate approaches to the bridge in the states of Illinois and Missouri, additional to or in extension of the approaches now existing; or

D. As intended to interfere with or limit the right of the Board of Public Service, or of any other duly authorized agency of the City, to grant licenses or permits for the use of any part of the bridge or of any approach thereto, for local switching movements, in such manner as not to interfere with through movements over the bridge, by any carrier in the manner herein contemplated.
