MANAGEMENT

20.04.010 Employment of Superintendent and other employees.
The Municipal Bridge Commission shall select and employ for the City one superintendent and other employees necessary for the operation of the Douglas MacArthur Bridge and in accordance with the civil service requirements of the Charter. The Superintendent and his assistants and subordinates, in charge of the operation of the railroad deck and its approaches, shall be in the exclusive employ of the City, and while so employed shall not accept or receive any employment or compensation or emolument of any kind from any railroad, other corporation or person. He and they shall perform their duties, subject at all times to the order and direction of the Commission. To the extent that money in the municipal bridge fund will permit the compensation of the Superintendent and of the other persons employed by or for the City to carry out the provisions of this division, shall be paid out of the municipal bridge fund, and to the extent that such fund may be inadequate, out of such other revenues of the City as may be provided by ordinance. 20.04.020 Superintendent--Powers and duties.
The Superintendent, acting either in person or through his assistants or subordinates authorized by him, shall have directing control, subject at all times to the orders of the commission, over the operating uses made by the railroads of the railroad and deck and railroad approaches of the Douglas MacArthur Bridge, and over the movements of traffic upon, over and across the railroad deck and railroad approaches, including private approaches when operating uses thereof or in connection with the railroad deck or public approaches thereto. 20.04.030 Operating rules and regulations.
The superintendent shall, from time to time, after conference with representatives of the using railroads, make and announce operating rules and regulations and time tables for the movement of traffic upon, over or across the railroad deck and approaches, as he may deem to be in accordance with good applicable railroad practice, and he shall have power to enforce same. 20.04.040 Controversy over rules and regulations.
In case any railroad shall deem any rule, regulation or time table, or any direction of the superintendent, to be unfair, unreasonable, impracticable or not in accordance with good applicable railroad practice, the railroad shall have the right, upon reasonable notice to the superintendent, to a prompt hearing of the controversy by the commission, whose decision shall be made promptly, and shall be conclusive and final. In the rules and regulations, and in practice under them, passenger trains shall always be given preference over freight trains. (1948 C. Ch. 19 § 11 (part): 1960 C. § 591.090.)
20.04.050 Railroad deck equipment.
The municipal bridge commission shall cause the railroad deck and its approaches to be equipped, and kept equipped, with all the necessary track, switch, signal and other equipment and devices required from time to time by good railroad practice, for the adequate and efficient conduct, control and movement of traffic, on and over the railroad deck and its approaches. If it proves necessary or desirable that any of the using railroads, during the period of their use of the railroad deck or its approaches, have additional installation of wires, signals, telephones or other devices for the use of such railroads in the operation of their locomotives or trains upon or across the railroad deck or its approaches, the board of public service, upon recommendation of the commission, shall have power to make or permit such installations upon terms for use of the Douglas MacArthur Bridge mutually agreed upon between the commission and any one or more of the railroads. 20.04.060 Record of violations of division.
It shall be the duty of the municipal bridge commission to take cognizance, and to keep a record, of all violations or failures to keep or obey any of the provisions of this division or of the rules and regulations announced hereunder governing the use of the railroad deck or approaches thereto. 20.04.070 Commission to recommend additional ordinances.
The municipal bridge commission shall, from time to time and as it may deem necessary or proper, report to the board of aldermen its suggestions and recommendations in respect of additional ordinances deemed by the commission to be desirable or necessary, in relation to the use of the railroad deck or its approaches, or any other subject matter of this division, and shall also report to any other duly constituted authority its suggestions and recommendations as to any orders or legislation which may be necessary or desirable in connection with the use of the railroad deck or approaches.
