The Community Development Commission shall be the Zoning Commission as provided for in Section 6 of said Act. (Ord. 59979 § 2 (part), 1986.)
26.04.040 Interpretation and purpose.
In interpreting and applying the provisions of the zoning code, they shall be held to the minimum requirements for the promotion of the public safety, health, convenience, comfort, prosperity and general welfare. It is not the intention of the zoning code to interfere with or abrogate or annul any easements, covenants or other agreement between parties; provided, however, that where the zoning code imposes a greater restriction upon the use of a building or premises or upon the height of a building, or requires larger open spaces that are imposed or required by other ordinances, rules, regulations, or permits or by easements, covenants or agreements, the provisions of the zoning code shall govern. (Ord. 59979 § 2 (part), 1986.)
